ORDER
New Delhi, the 11th November, 2020

S.O. 4044(E).—In exercise of the powers conferred by section 16, read with section 17 and section 25 of the Bureau of Indian Standards Act, 2016 (11 of 2016), the Central Government, after consulting the Bureau of Indian Standards (bis certification), is of the opinion that it is necessary and expedient so to do in the public interest, hereby makes the following order, namely:-

  1. Short title and commencement. – (1) This order may be called the Electrical Equipment (Quality Control) Order, 2020.
    (2) It shall come into force from the date as mentioned in column (5) of the Table to this order.
  2. Conformity to standards and essential requirements.– Every Electrical Equipment specified in column (2) of the Table to this order shall conform to the corresponding Indian standards specified in column (3) of the said Table with effect from the dates specified in column (5) thereof.
  3. Compulsory certification, marking and labelling.– (1) Every Electrical Equipment specified in column (2) of the Table to this order shall bear the Standard Mark under a licence from the Bureau of Indian Standards as per Scheme–II in Schedule–II to the Bis Certification (Conformity Assessment) Regulations, 2018

(2) In a case where the manufacturer of Electrical Equipment specified in column (2) of the Table to this order has obtained permission to apply the Standard Mark under a licence from the Bureau of Indian Standards as per Scheme–I in Schedule–II to the Bureau of Indian Standards (Conformity Assessment) Regulations, 2018, he shall not be required to obtain permission from the Bureau under a separate licence as per Scheme–II in Schedule–II to the Bureau of Indian Standards (Conformity Assessment)
Regulations, 2018:

Provided that nothing in this order shall apply in relation to goods and articles as specified in the column (2) of the said Table meant for export, which conform to any specification required by the foreign buyer.

  1. Certification and enforcement authority. – The Bureau of Indian Standards(BIS) shall be the certifying and enforcing authority in respect of the Electrical Equipment specified in this order, and in addition, whenever required, an officer not below the rank of an Under Secretary to the Government of India or District Industries Centre shall assist the Bureau in enforcement of this order.
  2. Penalty for contravention. – Any person who contravenes any of the provisions of this order shall be punishable under the provisions of the Bureau of Indian Standards Act, 2016 (11 of 2016).
  3. Date of effect of amendment or revision in Indian Standards. – Where any amendment or revision is made by the Bureau of Indian Standards in the title, scope, grade, testing requirements or any other parameters with respect to any Indian Standard specified in the Table to this order, such amendment or revision shall apply to the provisions of this order with effect from the date to be separately notified by the Bureau in consultation with the Department of Heavy Industry PDF, as if such amendment or revision is made under this order with effect from such date.
